About the position

This role is for a construction and infrastructure Legal Counsel working for Siemens Energy with a focus on the wind energy and grid technologies businesses, as well as other businesses along the whole energy landscape.

The successful employee will join a diverse group of lawyers and compliance professionals across the Asia-Pacific (APAC) region.

The position is based in our Bayswater and Burnley offices in Melbourne, Australia with occasional travel.
What are my responsibilities?

You will be a member of a dedicated, multi-national team of legal advisers and compliance professionals, supporting Siemens Energy’s aim to energize society. Working together with our internal business partners and the broader Siemens Energy Legal Department, you will provide contract review and deviations, negotiation, contracting and legal support for the entire lifecycle of energy projects (including during the bidding, negotiations, implementation, warranty and service phases of projects).

You will also provide legal support as required on a variety of issues, including dispute resolution, statutory advice, intellectual property and technology, competition law and other legal topics which may arise from time to time.

As our Legal Counsel you will act as a consistent, impartial and trusted legal adviser in all respects, providing guidance and direction reflecting sound judgment and substantive legal knowledge and expertise.

It will be your responsibility to advise internal business partners on, and support the preparation, drafting, negotiations, and handling of, complex and simple infrastructure projects involving construction, supply and service contracts. This may include design, engineering, procurement, installation and commissioning, service and maintenance of energy infrastructure. The projects are typically based on customer contracts included in requests for tender involving customer templates and detailed documents drafted by external law firms.,

Your tasks will include identifying and evaluating all contractual and commercial risks in relation to a project and presenting these for approval to senior management in accordance with internal guidelines.

Other tasks include review and negotiation of collateral warranty deeds., spare parts agreements, parent company guarantees, bank guarantees and direct end customer agreements. You will also be involved to some extent in procurement, subcontracting, dispute resolution and in providing general legal advice on a broad range of issues.

You will collaborate closely with the global Legal and Compliance community.

In the role you will clarify and coordinate issues with other legal colleagues, Sales, Project Management, insurance and other specialist departments throughout any project.

You will provide practical plain English business-oriented legal solutions to complex problems in a fast-moving environment, to enable business to progress in a legally compliant way without exposing the company to unacceptable risk.

A qualified lawyer with a minimum of three to six years of experience with a strong academic and legal background combined with relevant practical legal experience in-house or in private practice.

You have experience in making a general and detailed review and negotiation of terms and conditions for different types of project-related contracts and structures, including experience in construction / infrastructure law. Knowledge of and experience with international energy plant and system contracts or construction contracts (e.g. FIDIC) would be an asset.

You are a team player and a successful negotiator with strong assertive, listening and persuasion skills and a demonstrated ability to finalize transactions.

You have the ability to independently think through situations, apply relevant legal and statutory principles and provide well-reasoned compliant solutions to complex problems quickly. You must be able to communicate clearly with internal and external stakeholders at all organizational levels.

A good understanding of applicable law including statutory requirements as well as an ability and desire to learn new areas and skills.

A commitment to integrity, governance and the ability to address issues directly, including providing impartial and independent advice and challenging different assumptions and opinions when necessary.

Comfort working in a constantly evolving industry and a high-pressure, fast-moving environment with unclear and incomplete information.
